The judge rejects the filed motion by an Ethereum developer
Ethereum developer Virgil Griffith had filed a motion to dismiss the charges of violating sanctions law. According to the US government, Griffith has violated the sanction law, by speaking at a North Korea crypto conference. According to the motion, the government’s accusation against the Ethereum developer contains no actual allegation of fact. However, on Wednesday, the judge denied and rejected the filed motion in the Southern District of New York (SDNY). Despite, the judge again claimed that Griffith had violated the sanction law.
Ethereum developer guilty of helping North Korea
The prosecutors of the Southern District of New York, are accusing that the developer of Ethereum has violated the International Emergency Economic Powers Act. According to Kevin Castel, the United States judge, the violation of laws has been done by giving a speech at the Pyongyang Blockchain and Cryptocurrency Conference regarding cryptos’ uses to get around the US sanctions. Indeed, the judge rejected the motion filed by the lawyer of Virgil Griffith. The judge has left everything upto the jury to decide whether the Ethereum developer is guilty of helping the North Koreans, and circumvented the US economic sanctions using the digital currency.
Did Griffith render any service to North Korea?
Griffith’s team argued after the severe allegation and the judgment claiming the Ethereum developer guilty of violating sanction laws. Griffith’s team did not offer North Korea any service, as he never received any compensation for such speeches. Following this, Judge Castel stated that, as there is no proof that the DPRK paid the developer does not render the accused defective. Griffith is charged with a conspiracy of providing services to the DPRK, so the reason is sufficient.
Griffith is in the dark as to the accusations
In the latest judgement, the judge also denied the demand for a bill of particulars. It is also observed that the Ethereum developer’s attorney filed documents arguing that he is confused about what exactly he is being accused of doing. The judge wrote that the developer is in the dark about the services he provided to the DPRK. However, Griffith’s briefing to the court has clarified that he has learned a lot regarding the government’s evidence through the exploration.
