Apple Co-Founder Steve Wozniak loses against YouTube Bitcoin Scam Case

In the Wozniak vs YouTube Bitcoin scam case, the court ruled the accused as not guilty of the allegations made, giving the plaintiff a month to revise the filings. 

The recent court ruling over Apple co-founder Steve Wozniak’s lawsuit against YouTube LLC was held this Wednesday at the Santa Clara County Superior Court. Judge Sunil R. Kulkarnia concluded that per Section 230 of the Communications Decency Act, YouTube or its parent firm Google is not responsible for the platform-posted cryptocurrency-related scams. In the tentative ruling, the California state judge rendered the technology entrepreneur’s accusation invalid and gave him 30 days to try and revise his complaint.

Wozniak Vs YouTube Bitcoin Scam Case

July last year, Steve Wozniak, a.k.a Woz, sued Google’s YouTube over a typical bogus Bitcoin (BTC) giveaway scam that used his face as bait to market and lure in investors. Woz alleged that had the video hosting giant taken strict action over his requests to flag and take down those videos, things wouldn’t have escalated this far. In fact, instead, the social media platform was found to have “materially contributed” to the scam by selling targeted ads driving traffic to the videos and falsely verifying the fraudulent YouTube channels.

Wozniak also noted similar other crypto scams capitalizing on other tech celebrities like Microsoft’s Bill Gates and Tesla CEO Elon Musk. Apparently, similar tricks were also seen on Twitter, but while Twitter acted “that same day,” YouTube was unresponsive.

YouTube’s Immunity Under Section 230

However, these factors and arguments were not enough to overcome the Section 230 provided immunity that shields website platforms from third-party content, the judge inferred. Section 230 of the Communications Decency Act states that “an interactive computer service – provider or user” is not liable for “any information provided by another information content provider.” 

Woz’s isn’t the first suit to lose credibility against spurious YouTube ads owing to the Section 230 shield. Last July, a similar case against YouTube, filed by major crypto firm Ripple Labs, was dismissed on similar grounds. The latest verdict came the same day Google revoked its 2018 policy that banned cryptocurrency exchanges from using its advertising services.
