Sam Bankman-Fried is unable to make preparations for the trials. The lawyers of the former billionaire claimed that even though he was granted access to a laptop and internet from 8 AM to 7 PM on weekdays. But this is not the reality. Bankman was held up from visiting rooms due to another inmate. Once he arrived he was not permitted to use laptops without the presence of a lawyer. If he got access to the laptop in the presence of a lawyer then the WiFi speed was so slow that it took 10 minutes to upload a page.

Elaboration of the filing from the Defence

After a session of 5 hours, Bankman was able to load one document from the database. This is all due to internet issues and WiFi. Lawyers also add that he was brought in late and was forced to leave early.

The filing also reads that despite the Government’s efforts there is no way to solve the internet issues inside the cell. This means that Mr. Bankman has no time to review and search documents in the discovery database. These types of limitations are preventing him from preparing for the trials.

This is his second appeal, the previous appeal for pre-trial release was unsuccessful, given that he has failed the bail conditions multiple times which landed him in jail in the first place. Prosecutors claim that they have solved all the issues of Bankman related to the laptop but the lawyers are still pressing for the release.

Last month when the bail was revoked on the grounds of safety, Bankman-Fried’s team tried for his temporary release and greater computer access to work on his defense. They highlighted that his Sixth Amendment right was breached. The prosecutors have maintained that he had access to defense materials.

The DOJ filed a letter that says that Bankman has access to all the hard drives and a new battery has also been provided so that he can access several hard drives for preparing the needed defense materials. An internet-enabled laptop is provided every day of the week.

The letter from Bankman-Fried’s Lawyer has dismissed all the issues highlighted in the letter saying that he was unable to load more than one document due to poor internet speed.

Summary

The defense lawyers are demanding the temporary release of Sam Bankman. They were adamant with the filing that says -due to the poor internet, the client was unable to prepare for the trial. In a five-hour session, he downloaded only one document due to the WiFi issue. However, the Laptop issues were previously denied by the prosecutors saying that they had already fixed them.
