Court Pushes Coinbase to Refocus Subpoena on SEC Chair

  • Coinbase narrows its subpoena to focus on SEC Chair Gary Gensler’s communications during his tenure.
  • The initial request for Gensler’s records from 2017 was scaled back due to the judge’s reservations.
  • Coinbase filed the revised subpoena request on July 15 to gather relevant information for their case.

Coinbase has narrowed the subpoena down to Gary Gensler, the U.S. Securities and Exchange Commission (SEC) chairman. At the beginning of the discovery, the exchange requested all documentation of Gensler’s communication in his career. It now narrows down its focus on his communications while he was the SEC Chair.

Judge Katherine Polk Failla’s reservations inform Coinbase’s decision to alter the subpoena. From April this year, the exchange will begin requesting documents from Gensler’s tenure as the SEC Chair. This change is consistent with the judge’s concern regarding the probe for Gensler’s pre-SEC speech.

Coinbase Limits Subpoena to Gensler’s SEC Tenure

First, Coinbase wanted to obtain Gensler’s records starting in 2017. The exchange thought this would help them understand Gensler’s current and possibly changing approach to regulating cryptocurrencies. They said such information was critical for their defense in the SEC lawsuit.

Failla seemed worried about Coinbase’s broad initial request and was not in favor of allowing Gensler’s pre-SEC communications. Coinbase agreed to limit its request to documents when Mudge was at the SEC.

This revised approach concentrates on the following communication that Gensler has made since he was appointed as the Chair of the SEC in April 2021. Coinbase’s action comes after the judge advised them and in an attempt to gather information related to their case. They did this on July 15t, when they filed this revised request.

Coinbase Denies Violating Securities Laws Allegations

A lawsuit against Coinbase was filed by the SEC in June of 2023. The agency claimed that Coinbase offered to trade 13 securities tokens, violating federal securities laws. According to the SEC, the exchange has acted as an unregistered securities broker since 2019.

Coinbase has refuted these accusations, saying that the listed tokens should not be considered securities. They believe that these tokens are not governed by the SEC. This legal case is still ongoing and is important for the whole cryptocurrency sphere.

The exchange also claims that the SEC and FDIC are wrong to block some forms of documents. They accuse regulators of denying them FOIA documents used in packaging and posting information to the public. This allegation is the latest development in this intricate legal battle.

Bank of America Upgrades Coinbase Shares Rating

During the lawsuits, Bank of America enhanced its rating on the Coinbase shares. Based on a higher estimate of the company’s revenues, the bank increased its price target on Coinbase from $110 to $217.

Investment bank KBW also increased its target price on Coinbase from $160 to $230 while keeping the market performance rating. Such remarks from financial institutions show that they have faith in in the exchange.

Thus, Coinbase must file the opening brief on the motion to compel by July 23, and the SEC must respond by August 5. These filings are vital in the intralegal processes that are still in progress.

SEC Crackdown Signals Tougher Crypto Regulations

The conflict between Coinbase and the SEC is an example of the crypto sector’s issues with regulation. The decision could establish important legal benchmarks regarding cryptocurrencies and indicate the need for a proper legal framework in such a dynamic industry.

The SEC’s lawsuit against Coinbase is a step in the regulatory body’s clampdown on cryptocurrency firms. This case can set a precedent for other crypto exchanges and demonstrate how they can operate in compliance with federal securities laws.
