Fairshake is preparing to spend at least $30 million against Sherrod Brown’s Senate comeback bid following the CLARITY Act’s setback.

The Ohio campaign marks the cryptocurrency industry-backed group’s largest planned spending effort of the 2026 midterm cycle. Brown faces Republican Senator Jon Husted in a special election to replace Vice President JD Vance.

The announcement follows a Senate vote that blocked the industry-backed digital asset legislation. However, Brown played no part in that vote because he no longer serves in the Senate. His previous leadership of the Senate Banking Committee nevertheless made him a prominent opponent of industry-supported legislation.

Fairshake Returns to Ohio After Its 2024 Campaign

The group confirmed the planned $30 million campaign. Journalist Eleanor Terrett also reported confirmation from a spokesperson after The New York Times first reported the spending plan. The commitment follows more than $40 million spent helping defeat Brown in 2024.

Brown lost that election to Republican Bernie Moreno by about four percentage points. Moreno has since become a leading crypto advocate in the Senate. Now, Brown’s comeback campaign puts another Ohio contest at the center of the industry’s political spending.

Fairshake holds more than $120 million in assets, with funding primarily from Coinbase, Ripple, and the venture capital firm Andreessen Horowitz.

Ohio had remained a major target while the group kept its money sidelined for months. During that period, the CLARITY Act awaited Senate action and needed Democratic support to advance.

CLARITY Act Vote Deepens Political Dispute

All Senate Democrats voted against the legislation, alongside four Republicans. About a dozen Democrats had contributed to the bill before opposing its advancement.

Their objections included Republicans’ refusal to accept provisions that would prevent President Donald Trump from continuing to profit from cryptocurrency. Following the setback, Senator Kirsten Gillibrand and six Democratic colleagues reiterated their commitment to passing legislation through bipartisan negotiations.

Gillibrand also chairs the Senate Democrats’ main campaign organization and has supported the industry. Their joint statement described the vote as a setback rather than the end of their work.

However, Republican Senator Cynthia Lummis offered a different assessment, saying the bill was dead. She told HuffPost she doubted Democrats would support the legislation. The differing statements left lawmakers publicly divided over whether negotiations could still produce an agreement.

Brown Campaign Responds as Fairshake Spending Draws Scrutiny

Brown previously used his Senate Banking chairmanship to highlight risks associated with digital assets. If he returns, he could reclaim seniority and potentially become the committee’s chair or ranking member. His campaign has since moderated its criticism of the industry.

Campaign manager Patrick Eisenhauer responded by accusing Husted of serving wealthy donors and corporate interests. The campaign’s Monday statement did not mention cryptocurrency. Instead, it criticized Husted over data center expansion across Ohio and rising utility rates.

Meanwhile, Democratic operatives questioned the decision to target someone who did not participate in the Senate vote. Former Pentagon spokesperson Chris Meagher contrasted Brown’s treatment with that of Republican Senator Susan Collins, who voted against the bill. He questioned the group’s nonpartisan positioning in a social media post.

Fairshake supported Democrats and Republicans in major Senate races during 2024. Its plans for spending the remaining funds remain unclear. Some Democrats now fear that its spending will favor Republicans following the legislative defeat.
